The purpose of these regulations is to provide a code of conduct for your use of the Forums on Tasman Motorsport (TM).
- Conduct . You may use the TM forums for lawful purposes only and you may not transmit messages which are threatening, abusive, defamatory, vulgar, obscene or otherwise objectionable. You may not transmit messages which encourage conduct that constitutes a criminal offence or infringe upon the publicity or privacy rights or any other rights of any person or party. If you engage in any conduct which might, in TM's opinion, inhibit or restrictany other user's enjoyment of the Forums or Private Messages, or violate the above restrictions, TM may remove your posting and/or cancel your access to these areas of TM. TM, in its sole discretion, shall have the right to determine whether messages are in violation of these guidelines.
- Ownership of Messages. By posting messages on the bulletin boards or chat areas or forums, you are granting TM a royalty free, perpetual, non-exclusive and irrevocable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any posting by you (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed.
- No Advertisements. The Majority of TM's forums and chat areas are for discussion and debate. You may not use TM's forums or private message functions to post or transmit advertisements or commercial solicitations of any kind.
- Proprietary Materials. You may not post or transmit any material of any nature, including, text, audio, software, animation or photographs, belonging to any person or party other than yourself, without the prior, written consent of such owner. Simply because material is available on the Internet does not mean it is in the public domain. The vast majority of materials on the Internet are protected by copyright and trademark laws. Also, the material available on TM, including the forums are protected by copyright, owned either by TM or third party content providers and may not be disseminated by you without the consent of the copyright owner. You will be responsible for any damages resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from your posting or transmission.
- Monitoring. TM will have the right but not the obligation, to monitor the content of the forums. TM may retain the services of independent contractors to perform these functions. TM maintains the right, in its sole discretion, to edit, refuse to post or remove any material submitted to or posted on the fourms which TM believes is (i) in violation these guidelines, or (ii) irrelevant or outdated.
- Names. You will select a name to use in connection with your postings on the forums. However, you may not use a user name (or e-mail address) (i) with the intent of impersonating another person; (ii) belonging to another person without his or her consent; (iii) in violation of the intellectual property rights of any person; or (iv) that TM deems to be offensive. Whenever you post, your message will be automatically marked with your TM user name.
- Third Party Content, Products or Services. TM distributes content supplied by third parties and users of the forums. TM neither endorses nor guarantees the accuracy of all views, opinions, advice or statements made on TM. Products and services may be offered by third parties through advertisements that appear on TM. TM does not guarantee or endorse any products or services offered or sold and will not be responsible for any transactions between you and the seller.
- Privacy. TM collects no personally identifiable data about you, except that specifically and knowingly provided by you. Personally identifying information provided by you will be used only in connection with TM or for such other purposes as are described at the point of collection. Such information will not be transferred to any other parties unless otherwise stated at the time of collection. Although TM will endeavour to require third party content providers and other parties to adhere to TM's privacy policies, TM is not responsible for any actions or policies of any third parties.
- Equipment. You will be responsible for obtaining all equipment necessary to access TM, including computer hardware, modem and telephone charges and Internet access provider charges incurred.
- Termination. Either TM or you may elect to terminate the membership at any time.
These rules are binding on all users from the 28th of June 2006. Version 1.0
